Indika Prabath’s killer scot free, magistrate order SSP Elpitiya to appear before courts

 

On the 16 of July Balapitiya magistrate R. D. Janaka ordered ASP Elpitiya to appear before courts and give reasons for failing to arrest inspector Kolambage of the STF and produce him before the courts of  who deliberately arrested and shot Mahesh Indika Prabath 

Yesterday (16) the Magistrate, after considering the request made by the aggrieved party’s lawyer through a motion regarding the failure to arrest the killer responsible for the death of Indika Prabath, has ordered the Senior Superintendent of Police Elpitiya to appear before the court and present facts.

The Balapitiya Magistrate has ordered the postmortem on July 9, 2024. Despite eight days having passed given that order, the Senior Superintendent of Police has failed to arrest Superintendent of Police Elpitiya and present him to the court.

In the Constitution of Sri Lanka it is stated that everyone is equal before the law, but we have experienced that it is only a phrase. The police, who are in charge of maintaining law and order in the country, abuse their power and kill innocent people, but also use that power to avoid the courts. 

The Police Special Task Force arrested Indika Prabath on 12th October 2022 on suspicion of an incident in which he allegedly shot some people with a T56 firearm near the RIU Tourist Hotel in Ahungalla. However no one was killed or injured at the scene of the shooting.

On the same night (October 12, 2022, Indika Prabath was arrested at his Kottegoda residence in Matara by the Police Special Task Force and later he was brought to Ahungalla area. Police made a fabricated fiction claiming Prabath opened fire at the police with a firearm allegedly hidden by him and a police officer in retaliation shot Indika Prabath who died on the spot.

But the aggrieved party’s lawyers managed to prove that the fiction is a lie by contradicting the evidence of the police officers.

Based on the medical report and analysis of other evidence, the Balapitiya Magistrate announced the verdict that the death of Indika Prabath was not a self-defense shooting by the police special task force officers but a deliberate shooting. Meanwhile the Balapitiya Magistrate ordered the Senior Superintendent of Police Elpitiya to immediately arrest inspector Kolomboge of the Police Task Force responsible for the killing and present him to the court.

The resulting photograph is a photograph taken and published by the Police Special Task Force on October 12, 2022, when Indika Prabath was taken away blindfolded from his home.

Deputy Inspector General Varuna Jayasundara, who commands the Special Force of Police, has also come to Indika Prabath’s Kottegoda home on October 12, 2022 to arrest Indika Prabhat.
